A Schedule of Condition records the state of condition to a property at a given point in time. They are used for a number of purposes including, recording the existing condition prior to the agreement of a Party Wall Award, to limit the repairing obligations of a lease, following construction works and to protect owners and occupiers within shared properties.
A Schedule of Condition is undertaken prior to a lease agreement and often not relied upon until the lease expiry. It is at this point the benefit is realised for having a detailed Schedule, the benefits of which can include being able to limit the negotiations at the end of a term when a Dilapidation claim may be brought and can also limit the financial impact relating to the condition that the property is returned in.
